Terms of service

1. Scope

These terms govern your use of aethis.ai, the developer API at api.aethis.ai, the dashboard, the CLI, the MCP server, the SDKs, and any related developer surface (the “Service”) provided by Aethis Limited (Company No. 16627732, registered in England and Wales).

By creating an account, generating an API key, or calling the API, you agree to these terms. If you accept on behalf of an organisation, you confirm you have authority to bind it.

2. Status of the Service

The engine has been validated against the published benchmarks (Simpson 2026 §3) and is intended for production use. The developer surfaces around it — API, dashboard, CLI, MCP server, and SDKs — are in early access while pricing, rate limits, and the published API contract settle. Endpoint shapes, default rate limits, and pricing may therefore change. We will give reasonable notice of breaking API changes through release notes and the version field in API responses.

3. Accounts and API keys

  • You are responsible for keeping API keys confidential and rotating them if exposed.
  • You must not share an API key with parties outside your organisation.
  • You are responsible for all activity that occurs under your account or keys.
  • Notify us at security@aethis.ai if you suspect unauthorised use.

4. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy at /aup. We may suspend or terminate access for material breach.

5. Customer content and intellectual property

You retain ownership of the rules, tests, fields, guidance, and inputs you create or submit (“Customer Content”). You grant Aethis a limited licence to host, process, compile, and evaluate Customer Content for the purpose of operating the Service for you.

Aethis retains all rights in the Service itself, including the engine, the rule-authoring pipeline, the constraint solver, the API, the dashboard, and all associated software, models, and documentation. No rights in the Service are granted to you except as expressly set out here.

Decision outputs are made available to you under a non-exclusive licence to use within your application, subject to these terms.

6. Privacy and data processing

Our handling of personal data on aethis.ai and the API is set out at /privacy. Where you process personal data through the Service as a controller, our Data Processing Addendum applies and is available on request from legal@aethis.ai.

7. No professional advice

The Service evaluates rules that you or a third party have authored against inputs that you supply, and returns a decision, a proof, and an audit trail. Decisions are not legal, medical, financial, immigration, or other professional advice. You are responsible for deciding whether a decision is fit for use in your application and for any consequent action.

High-stakes outcomes affecting individuals must include a qualified human in the loop, as set out in the Acceptable Use Policy.

8. Suitability and evaluation

You are responsible for evaluating whether the Service meets the accuracy, latency, availability, and regulatory standards of your application before relying on it in production, and for putting in place appropriate testing, monitoring, fall-back, and human-review controls. The Service is one input into your decision pipeline; it is not a substitute for your own diligence, your professional judgement, or the controls your domain or regulator requires.

9. Service availability

We aim to keep the Service available but do not commit to a specific uptime during the early-access period. Planned maintenance and unplanned outages may occur. We are not liable for downtime or data loss, except as required by law.

10. Fees

Free-tier access during early access is subject to rate limits published in the dashboard. Paid plans, when introduced, will be set out in a separate order or pricing page. We will give at least 30 days’ notice before paid plans replace free access for an existing account.

11. Suspension and termination

We may suspend or terminate your access for material breach of these terms, the Acceptable Use Policy, or applicable law, with notice where reasonably practicable. You may stop using the Service at any time by deleting your account in the dashboard.

On termination, sections concerning intellectual property, confidentiality, disclaimers, indemnification, and liability survive.

12. Warranties and disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, or consequential loss, loss of profit, loss of revenue, or loss of data arising from these terms or use of the Service. Aethis's aggregate liability in any 12-month period will not exceed the greater of (a) the fees paid by you to Aethis in that period or (b) £100.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

14. Your indemnification of Aethis

You will indemnify and hold harmless Aethis Limited, its directors, employees, and agents from claims, damages, and reasonable legal costs arising out of (a) your Customer Content, (b) your use of decision outputs in your application, (c) your breach of these terms or the Acceptable Use Policy, or (d) your violation of applicable law. We will notify you promptly of any claim, give you reasonable control of the defence, and provide reasonable cooperation at your expense. You may not settle a claim that imposes any non-monetary obligation on Aethis without our prior written consent.

15. Changes

We may update these terms from time to time. Material changes will be flagged in the dashboard or by email at least 30 days before they take effect. Continued use after that date constitutes acceptance.

16. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes arising from them.
